New Children's Product Safety Laws

In February 2009, the U.S. Consumer Product Safety Commission (CPSC) will put new rules into effect which target lead and phthalates in a variety of toys and other children's products. According to many in industries affected, such as toy merchandisers and children's clothing retailers, this act will cause upheaval for domestic and international manufacturers, importers and retailers.

These extensive rules, New Children's Product Safety Laws, have met with tremendous opposition from domestic retailers and importers who believe these changes are due to an overzealous Congress reacting to recent recalls of over 20 million toys over a four month period. They state that little thought has been given to the staggering effect these rules will have on specific industries and small businesses.

Both sides agree that we must maintain safeguards for our children's products. However, the disagreement centers mainly on the following points: the laws are onerous and ambiguous, expense for business will make it impossible for some to continue operating, clarification of products is essential, and enforcement will be impossible since the CPSC has only 420 full time employees.

A basic view of rules that will go into effect:

  • After Feb 10, 2009, it will be illegal to sell children's products with lead content over 600ppm (parts per million). This includes inventory on hand. Congress has stated "that children's products that do not meet new lead limits would be treated as banned substances."
  • Children's products manufactured on or after Feb 10, 2009 must comply with restrictions on phthalates. Phthalates are chemicals used in a variety of industries to make flexible yet durable products. Three types of phthalates are totally restricted and 3 types have limitations placed on toys or articles that may be placed in the mouth of a child.
  • All toys must be tested by third party laboratories and certified by importer or domestic manufacturer using the form "General Certification of Conformity." No clear rules for record keeping have been established.
  • Children's toys are defined at products sold for ages 0-12 years
