Customs Issues Procedure for GSP Refunds
U.S. Customs and Border Protection announced October 24th instructions for obtaining duty refunds pursuant to the Generalized System of Preferences (GSP), which has been extended through July 31, 2013. The GSP extension is retroactively effective from January 1, 2011, with refunds available for duties paid on GSP-eligible merchandise from January 1st through November 4th. As of November 5th, GSP duty free claims may be made on consumption entries and warehouse withdrawals occurring on or after that date.
The initial announcement from CBP indicates that importers who paid duty on GSP-eligible goods, filed electronic entries, and used the proper special program indicator for GSP (“A” or “A+”) will receive automatic refunds. For entries that do not meet those requirements, refunds of duties paid should be requested in writing from CBP. Additional instructions will be announced once the GSP extension has been signed into law.
