New Consumer Products Safety Improvement Act will Provoke Headaches for Importers

The CPSIA implementation date of November 12th is quickly approaching. If you are a U.S. importer of consumable goods, do you understand the law and are you and your manufacturing partners prepared to adhere to the mandated protocol? Some of the elements include third party testing programs for child-related goods and certificates of conformity which must be provided by manufacturers, labelers, and importers for ALL consumer goods subject to the Act. Such certificates of conformity must also be forwarded to U.S. distributors and retailers. Additionally, imports of child-related products will also be subject to new lead content bans and plasticizer content restrictions in early 2009.

It is strongly advised that all importers of products regulated by the CPSC visit the agency’s website at www.cpsc.gov to read the Act in its entirety and forward desired comments to the CPSC during the allowable time frames. The multitude of products enveloped by this regulation is far-reaching and importers should understand the sections as they apply to their individual situation. Both criminal and financial penalties for non-compliance and falsification of records will be imposed and non-conforming shipments will require destruction, rather than re-exportation.
