Port of Charlotte Changes Policy for Non-Compliant Wood Packing Materials
As you may already know, wood packing material that has not been treated may contain insects that are not indigenous to the U.S. Allowing these untreated packing materials to enter the U.S. establishes a method of entry for these insects, which, if permitted could cause major environmental and economical impacts to the U.S. and worldwide.
The longer the untreated wood packing material sits in a storage facility, the higher the risks of these non-native insects leaving the wood and entering the ecosystem of the U.S. Also, the separation and/or tearing down of the wood packing materials further delays the exportation of these untreated products which poses an even greater risk.
Previously, manipulations to separate non-compliant wood products were allowed at the Port of Charlotte, NC. However, this will not longer be an option due to the inherent risks of possible insect infiltration. Effective June 16, 2008, the Port of Charlotte will begin re-exporting entire shipments where non-compliant packing materials have been used.
The current policy is as follows: CBP Agricultural Specialists will issue an Emergency Action Notification (EAN) when non-compliant wood products are detected at the port. Beginning June 16, 2008, the final deadline for filing export paperwork with the CBP Agricultural Specialist is five (5) days on the EAN. CBP form 7512 is used for Immediate Export or Transportation and Exportation when an IE is not possible must be filed within this 5 day time period.
If the correct documentation is not filed to CBP Agricultural Specialist within the allotted time period, a civil penalty may be issued to the importer for failing to comply with the EAN. These processes will be strictly enforced.
To help ease the transition to the new policy, Charlotte, NC CBP will continue to allow manipulations until June 16, 2008 unless a previous violation by the shipper or importer has occurred. CBP Port Director will evaluate each incident on a case by case basis. Regulatory action will be at the discretion of the Port Director.
