Ruling Redefines Classification of Set Components
January 2012 - The Court of International Trade has issued a ruling regarding the treatment of sets of items that are contained within packages not essential to the function of the items themselves. In previous instances, US Customs and Border Patrol has regarded cases or containers that hold a set of items as "unique" and not a part of the set, resulting in separate duty requirements for the cases. In the case heard by the Court of International Trade, Estée Lauder, Inc. v. United States, the position of CBP was rejected in favor of a decision to classify all articles comprising a set, including each individual case, as one item. The effects of this new position, pending potential appeal, may be significant for importers and exporters of various types of sets.
